December 27, 2004 – Crosby & Higgins LLP Settles $100 Million Suit Against Lord & Taylor and The May Department Stores Company

After almost two years of hard fought litigation, Todd A. Higgins, Esq. earlier this year successfully obtained a settlement for House of Dreams, Inc. d/b/a Nicole Miller Men (“Nicole Miller Men”) arising out of a $100 million lawsuit against Lord & Taylor and The May Department Stores Company. In its lawsuit, Nicole Miller Men alleged, among other things, that Lord & Taylor breached an exclusive distribution agreement between the parties pursuant to which Lord & Taylor allegedly agreed to purchase and distribute $100 million worth of Nicole Miller Men clothing in its stores over a period of seven years, with no less than 10 million per year.

Under the terms of the settlement agreement reached by the parties, Nicole Miller Men agreed to dismiss all of its claims and related appeals in the case.
