June 6, 2005 — Crosby & Higgins LLP recently secured an important and strategic settlement of certain infringement claims brought on behalf of Property Research Partners LLC, the developers of www.propertyshark.com, New YorkMagazine 2005 Editors’ choice for best New York real estate information website. Property Shark’s infringement suit involved claims against a direct competitor website that had “optimized” its site by using without permission Propertyshark’s principal register trademark “PROPERTYSHARK.” In addition, the competitor also lifted HTML and CSS code from propertyshark’s website resulting in a competing site that also looked and functioned much like propertyshark’s site. Crosby & Higgins LLP persuaded Propertyshark’s competitor to accept settlement terms that permanently enjoined it from optimizing with any Propertyshark trademarks and that permanently enjoined it from use of any CSS and HTML code from Propertyshark.
