Crosby & Higgins LLP is serving as lead counsel on behalf of a successful, international computer hardware manufacturer based in Singapore, prosecuting numerous claims in the United States District Court for the Eastern District of New York brought against its former distributor in the United States.  The dispute arises out of the distributor’s alleged scheme to rip-off the manufacturer’s business while still acting as its distributor.  According to the allegations in the case, the distributer secretly created a competing company to sell the same hardware products, using a confusingly similar trade name and on a confusingly similar website, all accompanied by instruction and product manuals that were virtually identical to those created by the manufacturer.  The manufacturer is seeking injunctive relief and substantial damages and has alleged claims for trademark infringement, trademark dilution, false designation of origin, copyright infringement, unfair competition, and breach of fiduciary duty.  The case is pending before the Honorable Judge Hurley and is scheduled for trial early next year.
