May 30, 2008 – Crosby & Higgins LLP Retained To Prosecute Claims For Breach Of Technology License Agreement And Patent And Trademark Infringement

Crosby & Higgins LLP has been retained on behalf of RevTech, Inc., an industrial technology company serving as global experts for ultra-violet cured materials on glass and ceramic surfaces, to represent it in an action against Voss of Norway and their affiliates. RevTech developed a leading process which permits the highly efficient and effective painting of a label onto the actual surface of a glass container rather than first printing the label and thereafter affixing it to the container. In Voss of Norway, et al. v. RevTech, Inc. (No. 07 CV 7649), a declaratory action filed in the United States District Court for the Southern District of New York, and pending before the Honorable Judge Louis L. Stanton, RevTech has counterclaimed alleging that Voss, their affiliates, and their product distributors, are in breach of a license agreement that the parties entered into. According to the Complaint, despite the fact that the agreement was validly terminated, Voss continued to utilize RevTech’s patented market-leading technology, and proprietary know-how to decorate Voss’ widely recognized premium bottled water product.  The counterclaims also allege that the continued use of RevTech’s registered intellectual property, including the ENVIROGLUV trademark, constitutes patent and trademark infringement. RevTech is seeking permanent injunctive relief, as well as damages estimated to be in excess of $10 million.
