April 11, 2006 – Crosby & Higgins LLP Takes Aim at $9 Million Dollar Fraud and Breach of Contract Claim
April 11, 2006
Crosby & Higgins LLP has been retained by the M&A advisory firm AG Limited d/b/a The Arundel Group to prosecute substantial fraud and contract related claims against the real estate investment firm, Liquid Realty Partners LLC. The litigation at issue concerns the acquisition of a controlling interest in French company, Buffalo Grill S.A, operator of more than one hundred Western-themed restaurants throughout Europe. The lawsuit seeks more than $9 million in contract and fraud damages as well as punitive damages arising out of Liquid Realty’s alleged wrongful conduct.
The case is pending in the United States District Court for the Southern District of New York where the Court recently denied in part a motion to dismiss filed by Liquid Realty Partners, allowing The Arundel Group’s claims for breach of contract, fraud, misappropriation and unjust enrichment to proceed. The case is scheduled for trial in June 2006.
