January 19, 2010 – Crosby & Higgins LLP files appearance in Federal District Court for the Northern District of New York for Indian-Based Manufacturer in Breach of Contract and Defamation Action; Files Counterclaims for Breach of Contract and Common Law Fraud

Crosby & Higgins LLP has filed its appearance as counsel of record for the defendant, a successful commercial printing company based in Mumbai, India, in a breach of contract and defamation action currently pending in the United States District Court for the Northern District of New York. The suit alleges claims for breach of contract and defamation arising out of the sale of a multi-million dollar line of custom made printing equipment that the plaintiff was supposed to manufacture on behalf of the client. The Answer, filed earlier this month, disputes those allegations and contends that the plaintiff was engaged in a classic bait and switch scheme intended to fraudulently induce the defendant into executing an agreement while knowing all along that the plaintiff would not be able to meet the contract’s requirements.  The case is currently pending before the Honorable District Judge McCurn and Magistrate Judge Lowe and is scheduled for trial in 2011.
