December 19, 2014 – Crosby & Higgins LLP Secures Default Judgment; Prevails on Motion to Dismiss Corporate Veil Piercing Claims Against Alter Ego/Successor Entities

Crosby & Higgins LLP has secured a substantial default judgment on behalf of a publicly traded middle market metals company, in a breach of contract action pending in New York State Supreme Court, Westchester County. The dispute arises out of the defendant’s alleged failure to complete the development and delivery of a software program. In addition to granting the plaintiff a default judgment on its contract claim, the Court also denied a motion to dismiss filed by the defendant’s alleged successor entities, finding that the plaintiff has properly alleged that they were in fact successors in interest and alter egos to the defaulting defendant.
The case is currently in discovery on the issue of successor/alter ego liability and expected to be ready for trial later this year.
