November 03, 2008 – Crosby & Higgins LLP Confirms New York Arbitration Award on Behalf of Japanese Based Company; Registers, Secures and Collects Full Judgment in Florida

Crosby & Higgins LLP is pleased to report that earlier this year it successfully moved before United States District Court Judge John E. Sprizzo in the Southern District of New York to confirm a substantial arbitration award obtained by a Japanese financial institution at the American Arbitration Association, and to enter judgment against the defendant, a New York based technology firm that appeared to be insolvent.  Thereafter, Crosby & Higgins LLP was successfully able to uncover substantial assets belonging to the judgment debtor in New York and Florida.  Following service of information subpoenas and restraining notices in New York and Florida, Crosby & Higgins LLP successfully asked the United States District Court for the Southern District of Florida, before Judge Ursula M. Ungaro, to domesticate the judgment with interest, which on October 27, 2008, led to the defendant agreeing to a final order of garnishment and full payment of the arbitration award.  The persistence of the client, combined with the diligent actions of Crosby & Higgins LLP in ferreting out the assets, enabled the client to collect on its judgment in full, despite the efforts of the judgment debtor to shelter its assets in Florida.
