Crosby & Higgins LLP has successfully resolved claims alleging violations of the Americans With Disabilities Act of 1990, New York State Human Rights Law, and New York City Human Rights Law in connection with the website and mobile phone application of its client, a major online resale marketplace for buying and selling luxury and designer contemporary fashion. In an action filed in the U.S. District Court for the Eastern District of New York, a visually-impaired legally blind man asserted ADA claims against the client, alleging that its website contained access barriers and failed to provide reasonable accommodations under the ADA that would allow him to make purchases on the website, including by failing to provide compatibility with screen-reader software. Crosby & Higgins LLP was able to successfully resolve the matter for the client and avoid costly discovery and motion practice through the entry of a voluntary consent decree that outlined compliance initiatives for both the client’s website and mobile phone application. The case was discontinued with prejudice.
