April 1, 2005 -- Crosby & Higgins LLP has been retained by GE Healthcare Technologies (formerly GE Medical Systems) to defend an appeal of its trial court victory by summary judgment against a Long Island medical facility.  In the trial court, Mark R. Crosby, Esq., successfully defended GE’s decision to break off protracted negotiations between the parties over the desired installation of certain GE MRI technology at the facility. In addition, the trial court dismissed in its entirety the medical facility’s liquidated damages claim of nearly $2,000,000.  

The appeal is pending before the Appellate Division of the Supreme Court of the State of New York, Second Department, and is scheduled to be heard on the Court’s September 2005 term.
