December 12, 2005 -- Crosby & Higgins LLP has secured an appellate victory on behalf of General Electric at the New York State Appellate Division, Second Department in NGR, LLC v. General Electric Co., --N.Y.S.2d --, WL 3305098 (App. Div. Second Dep’t Dec. 5, 2005), in a ruling unanimously affirming the trial court decision awarding summary judgment to General Electric on the plaintiff’s claim for promissory estoppel arising out of the parties business negotiations.  The Appellate Division explained:

Contrary to the plaintiff's contention, the Supreme Court correctly granted the defendant's motion for summary judgment dismissing the complaint as the defendant established its freedom from liability as a matter of law. The failure of the parties' complex business negotiations did not, under the circumstances herein, give rise to a claim for damages (see Resurgence Asset Mgt. v Bastion Capital Fund, 306 AD2d 336; Wiscovitch Assoc. v Philip Morris Cos., 193 AD2d 542).
