Attorneys for Crosby & Higgins LLP have appellate experience before the United States Supreme Court, the Second Circuit Court of Appeals, and the Appellate Division of the Supreme Court of the State of New York. Our attorneys bring to their cases thorough knowledge of appellate procedure and key areas of substantive law, including business torts, contracts, securities, antitrust, commercial code, labor and employment, products liability and insurance law.
Our appellate attorneys handle all phases of the appellate process including carefully evaluating the decision of the lower court or administrative tribunal; preparing and presenting post-trial motions; seeking stays of proceedings and/or leave to appeal when necessary; preserving, presenting, and thoroughly reviewing the lower court record; preparing high quality appellate briefs and appendices and forcefully presenting well-prepared oral arguments.
When settlement on appeal is appropriate, our appellate attorneys attend settlement conferences or participate in mediations, frequently conducted by retired appellate judges or mediators specially trained and appointed by the appellate courts. Once an appellate court has concluded its review, our appellate attorneys also prepare and respond to petitions for rehearing, petitions for review, and petitions for writ of certiorari.
